Labour And Employment Law

Employee rights have gained enhanced protection under the Constitution of Kenya 2010, various Statutes and Judicial Interpretation. One of the most significant changes brought about by the Statutes is the requirement of substantive and procedural fairness in the termination of employment. It is now not unlawful to terminate employment for convenience purpose only by issuing a notice. Termination must be just and fair, therefore it is important for both employers and employees to seek expert legal advice to ensure compliance with the applicable laws.
